Retail sales associate postings are often copied across every store in a chain: "Provide excellent customer service, maintain store standards, flexible availability." The candidate cannot tell whether the job is folding and recovering an apparel floor for 20 hours a week, selling appliances on commission, or working the fitting room and register at a mall store that closes at 10 p.m. Those details decide who applies and who stays, and a few of them have legal weight: how commissions and overtime work, whether your city or state requires a schedule estimate, and what minors may do. A useful retail sales associate job description names the store, the selling duties, the pay plan and the real schedule. Then agree with the store manager on three numbers: hours per week offered (an estimate), the shifts you most need covered, and the heaviest regular lift during shipment processing. If the job is mostly the register, the cashier job description template fits better.

Commission, overtime, scheduling and minors

Commission and overtime. Paying commission does not by itself remove overtime. The federal section 7(i) exemption applies only if the employee works for a retail or service establishment, their regular rate in an overtime week is more than one and one-half times the applicable minimum wage, and more than half of their total earnings in a representative period (at least one month, no more than a year) are commissions; otherwise overtime is due for hours over 40 (DOL Fact Sheet #20). The exemption covers overtime only; minimum wage still applies to every hour. Describe the plan plainly: base rate or draw, commission rate or tiers (as examples), and how overtime is handled.

Scheduling. Some jurisdictions regulate retail schedules. Oregon's law covers retail, hospitality and food service employers with at least 500 employees worldwide, requires a written good-faith estimate of the work schedule at hire, schedules provided at least 14 calendar days in advance, and generally bars scheduling within 10 hours of the end of the previous day's shift unless the employee agrees (Oregon BOLI). Some cities have their own scheduling ordinances. Put an honest hours estimate and shift pattern in the posting wherever you hire.

Minors. Federal rules let 14- and 15-year-olds do most retail work, including stocking shelves and cashiering, but limit hours to 3 on a school day, 8 on a non-school day and 18 in a school week, between 7 a.m. and 7 p.m. (9 p.m. from June 1 through Labor Day). They may not work from ladders or operate power-driven machinery other than office machines, and Hazardous Occupations Order 12 bars anyone under 18 from operating balers and compactors (DOL Fact Sheet #43). Pay and EEO

Post the hourly range and the commission or bonus plan, and check your state's pay transparency rules. The BLS Occupational Outlook Handbook profile for retail sales workers (last modified August 27, 2026) publishes pay data and says most receive on-the-job training lasting a few days to a few months, with schedules that may include evenings and weekends; this page does not quote figures. Common mistakes in retail sales associate job descriptions

"Flexible availability required"

Name the shifts. Candidates with fixed school or second-job schedules will self-screen accurately.

Vague commission language

"Uncapped earning potential" without the plan invites distrust. Give the structure with labeled example numbers and say how overtime works.

Age lines that do not match the work

A blanket "18 or older" excludes 16-year-olds you could hire; no age line in a store where associates run the baler does the opposite.

Requiring retail experience for an entry-level floor job

It shrinks the pool for work BLS describes as trained on the job.

Questions people ask

Do commissioned retail sales associates get overtime?

Usually yes, unless the federal section 7(i) exemption applies. It requires all three: the employee works for a retail or service establishment, their regular rate in an overtime week is more than one and one-half times the applicable minimum wage, and more than half of their earnings over a representative period of at least one month come from commissions. If any condition fails, overtime is due. State law can be stricter.

Can a 14- or 15-year-old work as a retail sales associate?

Under federal rules, yes: retail work, stocking shelves and cashiering are permitted for 14- and 15-year-olds, within limits of 3 hours on a school day, 18 hours in a school week and work only between 7 a.m. and 7 p.m. (9 p.m. from June 1 through Labor Day). Do retail job postings have to include a schedule estimate?

In some places, yes. Oregon's predictive scheduling law, for example, covers retail, hospitality and food service employers with at least 500 employees worldwide and requires a written good-faith estimate of the work schedule at hire and schedules posted 14 days in advance. Some cities have their own scheduling laws. Even where it is not required, a schedule estimate is the most useful line in the posting.

Should a retail sales associate job require experience?

Usually not. BLS says most retail sales workers receive on-the-job training lasting a few days to a few months. Require experience only for commission roles selling complex products, such as appliances, furniture or electronics, and say so.
